Terms of Service
1. Service Description
UFast Notepad ("the App") is a fast notepad application developed and operated by MyCompany ("we," "us," or "our"). The App provides quick note-taking functionality with features including auto-save, end-to-end encryption, cloud synchronization, and customization options.
The App is available on Android (Google Play) and as a web application (PWA). Some features require a Google account for sign-in and cloud synchronization.
2. Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. We reserve the right to modify these terms at any time. Continued use after modifications constitutes acceptance of the updated terms.
3. User Obligations
When using the App, you agree to:
- Use the App only for lawful purposes and in compliance with all applicable laws and regulations.
- Not attempt to reverse engineer, decompile, or disassemble the App.
- Not use the App to store, transmit, or distribute illegal, harmful, or offensive content.
- Maintain the confidentiality of your account credentials and PIN.
- Not attempt to gain unauthorized access to the App's servers, databases, or other systems.
- Not use automated means (bots, scrapers, etc.) to access or interact with the App.
4. Account and Authentication
You may use the App without creating an account for basic local note-taking. To use cloud sync and other online features, you must sign in with a Google account. You are responsible for all activity under your account.
Your notes are encrypted with your personal PIN. If you lose your PIN, we cannot recover your encrypted notes. We are not responsible for any data loss resulting from a lost PIN.
5. Intellectual Property
The App, including its design, code, features, branding, and all related materials, is the intellectual property of MyCompany and is protected by applicable copyright, trademark, and other intellectual property laws.
You retain full ownership of the content you create within the App (your notes). We do not claim any rights over your content. Due to end-to-end encryption, we cannot access the content of your notes.
6. Pro Purchase and Refund Policy
The App offers a "Pro" upgrade as a one-time, non-recurring purchase through Google Play. The Pro upgrade unlocks premium features including premium fonts, paper textures, and wallpapers.
- Pricing: The Pro purchase price is displayed in your local currency on the purchase screen. Prices may vary by region.
- One-time payment: Pro is a lifetime purchase. There are no subscription fees or recurring charges.
- Refunds: All purchases are processed through Google Play. Refund requests are subject to Google Play's refund policy. You may request a refund within 48 hours of purchase through Google Play.
- Restore: If you reinstall the App or switch devices, you can restore your Pro purchase by signing in with the same Google account and using the "Restore Purchase" option.
7. Service Changes and Interruption
We strive to maintain the App's availability, but we may:
- Modify, update, or discontinue features at any time with reasonable notice.
- Temporarily suspend the service for maintenance, updates, or unforeseen technical issues.
- Discontinue the App entirely with at least 30 days' advance notice to registered users.
We will make reasonable efforts to notify you of significant changes through in-app notifications or push notifications. Local note-taking functionality will continue to work offline regardless of server availability.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure.
- Any defects will be corrected.
- The App will meet your specific requirements.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYCOMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.
Our total liability for any claims arising from or relating to these terms or the App shall not exceed the amount you paid for the Pro upgrade, if any.
10. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Seoul, Republic of Korea.
If you are a consumer in the European Union, you may also benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these terms affects your rights as a consumer to rely on such mandatory provisions of local law.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
